The licence granted for photographs provided in the eighties and nineties to the Daily Mirror by a freelance photographer did not cover their use in archive websites of newspaper back copies. This decision made by the High Court has been upheld by the Court of Appeal because a term extending the licence for that purpose could not be implied as online publication could not have been considered by either party at the time.
