RIPA: Order amends bodies with powers to access communications data

The Regulation of Investigatory Powers (Communications Data) (Amendment) Order 2015 (Order) came into force on 12 February 2015.

Some time ago the government announced its intention to reduce the number of organisations that have access to communications data under the Regulation of Investigatory Powers Act 2000 (RIPA) and the Order does remove powers to access communications data under RIPA from 13 public authorities including the Department for Business, Innovation and Skills, the Environment Agency and the Charity Commission.

However, it also adds a new statutory purpose to RIPA to allow for the Financial Conduct Authority and Prudential Regulation Authority to access communications data under RIPA for the purpose of non-criminal enforcement of financial services regulation.
